Eco Ruralis Takes Legal Action Against Illegal Pesticide Derogations in Romania

Eco Ruralis, a small-scale farmers' organization in Romania and a participant in the Nyéléni ECA network, has launched a legal challenge against the Romanian Ministry of Agriculture. In collaboration with the beekeeper federation ROMAPIS, Eco Ruralis is contesting the ministry’s decision to grant a derogation for the use of neonicotinoid pesticides, despite a European Court of Justice (ECJ) ruling confirming their ban due to environmental risks.

Challenging Illegal Derogations

Legal precedents have already established that Member States cannot override the EU-wide prohibition on these harmful chemicals. Nevertheless, the Romanian government has repeatedly issued derogations, violating EU law and endangering ecosystems.

Four major Romanian agribusiness organizations, all members of Copa-Cogeca, have joined the case in support of the Ministry of Agriculture, claiming that corn and sunflower production in Romania is impossible without these banned pesticides. They further allege that beekeepers and bees are not affected, contradicting extensive scientific evidence.

While several chemical companies and industry lobby groups sought to intervene in defense of the government’s position, only these four agribusiness organizations were admitted to the case.

Legal Arguments & Institutional Barriers

The legal defense in this case is built upon the ECJ ruling and three key EU regulations explicitly banning clothianidin, thiamethoxam, and imidacloprid. However, Eco Ruralis’ legal battle has faced persistent institutional hostility. The organization was accused of being unrepresentative and was repeatedly denied participation in the decision-making process—a blatant disregard for peasant farmers’ voices.

This case exposes a systemic pattern of discrimination against peasants and small farmers in Romanian policymaking. Before this legal challenge, no peasant organization had ever been consulted when granting neonicotinoid derogations—a process that lasted 12 years, resulting in a total of 57 derogations.

A Critical Fight for Farmers' and Environmental Rights

Eco Ruralis' legal action marks a significant step in the fight for environmental justice and peasant rights. It highlights the urgent need for transparent, inclusive decision-making in agriculture, where corporate influence does not override biodiversity, food sovereignty, and the rights of small-scale farmers.
